Terms of Service

1. Acceptance of Terms
By accessing or using Momentm ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the Service. These Terms constitute a legally binding agreement between you and Momentm Technologies Ltd. Continued use of the Service after any changes to these Terms constitutes acceptance of the new Terms.
2. Use of Service
You may use Momentm to discover, follow, and share products in accordance with these Terms. Permitted uses include creating product profiles, posting updates, engaging with other users, and participating in deals. Prohibited actions include: scraping or systematically harvesting data from the platform, impersonating any person or organisation, posting misleading or fraudulent product information, sending unsolicited commercial messages (spam), and attempting to circumvent any technical security measures. Violations may result in immediate suspension or permanent termination of your account.
3. User Accounts
To access most features of Momentm, you must register for an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account at security@momentm.build. Momentm reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for extended periods. You may delete your account at any time through Account Settings.
4. Content & Intellectual Property
You retain ownership of all content you post to Momentm, including product descriptions, updates, images, and other materials ("User Content"). By posting User Content, you grant Momentm a worldwide, non-exclusive, royalty-free licence to use, reproduce, display, and distribute your content for the purpose of operating and promoting the Service. You represent that you have all necessary rights to grant this licence. Momentm's own intellectual property — including the platform design, software, trademarks, and proprietary content — remains exclusively owned by Momentm Technologies Ltd.
5. Products & Deals
Creators are solely responsible for the accuracy and completeness of product information listed on Momentm. Publishing false, misleading, or deceptive product claims is strictly prohibited and may result in legal liability. For Deals, the creator is the seller of record and is obligated to fulfil their stated offer terms. Momentm acts as an intermediary platform only. Refund requests for deals should be directed to the creator in the first instance; if unresolved, Momentm may mediate disputes at its sole discretion. All deal transactions are final once a refund window (typically 30 days) has passed.
6. Payments
Payment processing on Momentm is handled by Stripe, Inc., subject to Stripe's own terms of service. Momentm charges a platform fee of 5% on all deal transactions, deducted automatically at the time of payout. Subscription fees for Pro and Business plans are billed monthly or annually in advance and are non-refundable except as required by applicable consumer protection law. Disputed charges should be raised with support@momentm.build within 60 days of the transaction date. Momentm reserves the right to modify its fee structure with 30 days' prior notice.
7. Privacy
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, available at momentm.build/privacy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy. If you have questions about how your data is handled, contact us at privacy@momentm.build.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Momentm, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service. This includes but is not limited to loss of revenue, loss of data, or loss of goodwill. Momentm's total aggregate liability for any claim arising from these Terms shall not exceed the greater of (a) USD 100 or (b) the amount you paid to Momentm in the 12 months preceding the claim. Some jurisdictions do not allow exclusions of certain warranties or limitations on liability, so the above limitations may not apply to you.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka for the resolution of any disputes arising from these Terms or your use of the Service. If you are a consumer located in the European Union, you may also have rights under EU consumer law that override certain provisions herein.
10. Changes to Terms
Momentm reserves the right to modify these Terms at any time. For material changes — those that substantially affect your rights or obligations — we will provide at least 30 days' prior notice via email to the address associated with your account and via a prominent notice on the platform. Non-material changes (such as corrections, clarifications, or additions to permitted uses) may take effect immediately upon posting. It is your responsibility to review the Terms periodically. Continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms.
